IMPORTANT: BEFORE ACCEPTING THIS AGREEMENT, CAREFULLY READ THESE GENERAL TERMS OF USE, THEN PRINT THEM OUT AND SAVE THEM, ALONG WITH ALL CONFIRMATION E-MAILS, SMS MESSAGES, ADDITIONAL TERMS, TRANSACTION DATA, GAME RULES AND PAYMENT METHODS RELATED TO THE PLATFORMS AND / OR SERVICES USED BY YOU. WE WILL NOT KEEP YOUR AGREEMENT WITH US, SO PLEASE PRINT IT FOR YOUR RECORDS. THESE GENERAL TERMS AND CONDITIONS OF USE ARE SUBJECT TO CHANGE (AS INDICATED BELOW).
By clicking on “I Accept” or “I Agree” and / or using the Services (as defined below), you agree to perform your obligations under this Agreement. Once you (as defined below) click on “I Accept” or “I Agree”, or use the Services, (a) you, the end user ('You'), enter into a legally binding agreement in accordance with these General Terms of use with (b) ElectraWorks Europe Limited ('We', 'Us' or 'Our').
ElectraWorks Europe Limited is licensed by the National Revenue Agency under the Bulgarian Gambling Act to organize online casino games and online betting with fixed odds. ElectraWorks Europe Limited is also authorized and regulated by the Maltese Gambling Commission under the Gambling Act.
We offer services on the bwin.com websites (collectively 'bwin platforms') and other online or mobile platforms of ours (each separate site being a 'platform') through which you access Our gaming and betting services, including (but not limited to) Sports betting services and Game services (as defined herein below) using your account ('Services').
In the event that you have any complaints, claims or disagreements regarding results related to the Services or other activity performed by Us, you must first contact us in accordance with section 22 below.
These General Terms of Use together with the Privacy Policy, the Rules for Providing Sports Betting Services, the Conditions for Broadcasting Sports Events, the "Tournaments" section, the "How to Play / Start the Game" sections and the "Game Rules" section Frequently asked questions, all additional rules of the games, Disconnection and cancellation policy section, Standard conditions for participation in promotions, Conditions for receiving bonuses and commissions, Third Party Content Use Policy, Customer Loyalty Program, and any other additional terms and conditions published on the Platforms and communicated to you by email, which relate specifically to and govern events, games, software, promotions or tournaments, constitute a legally binding agreement between You and Us (the 'Agreement'). Upon receiving an email notifying you of changes to the terms or conditions of the Agreement, you have the option to stop playing and / or terminate your account in accordance with Section 18. We recommend that you read all these documents carefully, as each of them is an integral part of the legally binding agreement between You and Us.
IF THIS AGREEMENT HAS BEEN TRANSLATED INTO ANOTHER LANGUAGE, IN THE EVENT OF A CONFLICT BETWEEN THE TRANSLATION AND THE BULGARIAN DOCUMENT, PRIORITY IS GIVEN TO THE BULGARIAN VERSION.
Please note that these General Terms of Use take precedence in the event of a discrepancy between these General Terms of Use and any other game rules or other documents relating to these General Terms of Use.
By clicking on the 'I Accept' or 'I Agree' button and by accepting these General Terms of Use, you also acknowledge and accept this Agreement. Access to and use of Our Services is governed by this Agreement. If you have any questions about this Agreement, we encourage you to seek independent legal advice.
Services and interactive features (including some games) may vary depending on the Platform you use to access them. For example, gift certificates and internal transfers to the account are not available on the Facebook platform.
Please also pay attention to our Privacy Policy, which describes the principles of use and protection of your personal data. By accepting these General Terms of Use, you also acknowledge and accept the Privacy Policy.
SPORTS BETTING SERVICES
Sports betting services are the services provided by Us through the following platforms: bwin.com and all other sports betting platforms that we offer at the moment ('Sports betting services').
If you use or intend to use the Sports Betting Services, you must follow the terms in Section 28 of these General Terms of Use, which applies specifically to the Sports Betting Services.
GAME SERVICES
Game services are the services provided by Us through the following platforms: bwin.com and all other game platforms that we currently offer ('Game Services').
If you use or intend to use the Game Services, you must follow the terms in Section 29 of these General Terms of Use, which apply specifically to the Game Services.
APPLICATION OF THE AGREEMENT
By confirming that you have read this Agreement upon registration and / or by clicking on the 'I Accept' or 'I Agree' button when installing software relating to the Services provided through the platforms or upon registration of your account, you agree to comply with this Agreement, and agree that failure to comply with the Terms of this Agreement may result in disqualification, closure of your account (as defined in Section 3 below), confiscation of funds and / or litigation against you, as the case may be and as specified further in this Agreement. You agree that if you accept this Agreement, We will immediately provide the Services to you. As a result of this, if you accept this Agreement, when you register for Our Services, You may not subsequently cancel your registration, though you can close your account as specified in Section 18 below.
LEGALITY OF USE OF THE SERVICES
2.1
You may use the Services only if you are at least 18 years of age (or have reached the age of majority under the laws of your country) and the use of these Services is lawful under the laws in force in your country. We reserve the right to ask you for proof of your age and your account may be blocked until you provide us with satisfactory proof of age. You understand and agree that we cannot provide you with legal advice or guarantees and that you assume full responsibility for compliance with all applicable laws in your country and that you have the full legal right to use these Services. You agree that the participation of minors in gambling is not permitted and we may report any such attempts to our regulator, which may refer them to the relevant local public prosecution authorities. In addition to the above, the access to Our Services may be restricted to certain territories. Any use of the Services is carried out at your own request, at your discretion and at your risk. By using the Services, you acknowledge that you do not consider these Services to be offensive, objectionable, dishonest or obscene in any way.
2.2
In order to use our services, you must provide sufficient data and documents to be uniquely identified. If we are unable to confirm your identity at the time we receive your application to open an account and deposit funds, we will ask you for the relevant identifying documents that you are required to hold to confirm your identity.
The information that identifies you relates to:
- Your nationality;
- Names on your identification document;
- Identification number, which may be a Unique Civil Number (UCN), a Foreign National Identity Number (FNID), a Personal Identification Number (PIN), a Service Registry Number (NRA number), a Unique Identification Code of a Foreign Individual (UIC of a PFL), a Personal Identification Number or other number or identification data under the relevant national legislation of a person who is not a Bulgarian citizen;
- For persons without an ID number or an NRA/LN/ID number of a PFL, the address of temporary or permanent residence in the Republic of Bulgaria or in another country, date of birth, number, date of issue and issuer of the identification document are also required.
We make an assessment of the sufficiency and reliability of the information you provide to us.
Your ability to use our services while we verify your account will be limited.
If you are unable to provide us with the required documents or we are unable to uniquely identify you, we may ask you to provide us with additional documents.
If we are still unable to confirm your identity after you have provided them, we will cancel the transactions and all bets (including winnings) made by you during this period and close your account.
Any deposits made by you will be returned and any bets placed and any winnings will be void.
We process your data in full respect of the data protection rules. In case of changes and for more information, see our Privacy Policy.
2.3
If, as a result of an age check, we find that you have not reached the age of majority, you will not be able to open an account with Us.
As well as identity checks, we also carry out checks for vulnerable persons. In the event that we identify you as being on the Vulnerable Persons Register, any deposits made by you will be returned and any bets placed and any winnings will be voided. For more information, see Responsible Gambling.
If you believe that you have a gambling problem, and/or are a person whose social circumstances and/or income level may make you more susceptible to participating in gambling and developing a gambling addiction, you have the right to sign up to the "Vulnerable Persons Register" for the purpose of being banned or barred from gambling.
You may no longer use our Platform while you are on this register.
ACCOUNT / REGISTRATION
3.1
In order to use the Services, you must first register an account with Us. You may access all of our Services from your account (as defined below).
3.2
You can open an account with us by choosing a unique username and password and entering the necessary information in our registration form, for example (but not limited to) name and surname, postal address, e-mail address, sex, date of birth and telephone number ('Account'). You ensure that the information provided during registration (or thereafter) is accurate and up to date. You can change some (but not all) of the data entered during registration by editing your account settings or by contacting us. For more information, please see Our Privacy Policy. 3.3
You may choose between Bulgarian Lev and Euro as account currency ('Account Currency'). Please note that once you have selected a currency, you will not be able to change the currency of your account more than once without Our approval (which may be denied or delayed at Our discretion). If you want to change the currency of the account more than once, please contact us. Changes in the currency of the account are made according to the conditions and according to the Exchange Rates that we offer during the conversion. 3.4
There is no fee for opening an account. We are not a bank and the funds are not insured by a government agency. All payments to and from your account are made in the currencies available to the Services at that time and are interest-free. You guarantee that all payments in your account come from a payment source for which you are the account holder.

3.5
In order to participate in real money games or to place a bet, you need to deposit 'real' money into your account using one of the methods we offer at the relevant moment. These funds will be credited to your account at the time of the actual acceptance of the funds by Us and / or Our agents. Minimum and maximum limits may apply to the payments in your account depending on your history with us, the method of deposit and other factors determined solely at our discretion. 3.6
You can request a withdrawal from your account at any time, provided that no funds are owed to us, your account is not restricted in accordance with these Terms of Use and all winnings have been verified. Where possible we will to pay any withdrawal in part or in full through the same payment method and in the same currency in which your deposits were made.
3.7
To use certain Services, you may first need to download and install software provided on the respective Platform.
IDENTIFICATION AND ONE ACCOUNT
The name of your account must match your real name registered in the official documents and the name indicated when registering your account must match the name on the credit card or other payment accounts used to make a deposit or receive funds in Your account. To verify your identity In order to verify your identity we may ask you for proof of identity at any time (including, but not limited to, copies of a valid passport / ID card and / or a copy of the payment card used, provided you hold such a document) and address verification (including but not limited to) a recent utility bill or bank statement). If you fail to provide the necessary documents or we are unable to verify your identity using the documents you have provided, your account may be blocked whilst we verify your identity and if we are unable to verify your account we will close your account. If your account is closed all bets placed and winnings derived will be voided and your deposits returned. You may not own more than one (1) Account in connection with the use of the Platforms. If you have more than one (1) Account or Accounts registered under different names, you must contact us immediately to merge all your accounts into one (1) account. We reserve the right to close your account (s) if you open multiple accounts. If we have good reason to believe that you have opened several accounts with the intent to defraud the Company, we reserve the right to cancel all transactions related to the attempted fraud. If you have forgotten your username or password, please contact us to recover them.
EXCLUSION OF GROUP ASSOCIATES, PARTNERS, BOOKMAKERS, SPORTS PARTICIPANTS OR PROHIBITED PERSONS
If you are (i) a member of the board of directors, director, associate, consultant or agent of ElectraWorks Europe Limited or any of its direct or indirect subsidiaries (the 'Group'); (ii) a supplier or seller from the Group; (iii) (only in connection with Sports Betting Services) a bookmaker or betting agent or a person involved in any way in the creation, organization or holding of an event for which We accept bets (including, but not limited to, sportsmen, athletes, official representatives, members of sports clubs and / or leagues), you are prohibited from registering an Account with us or using directly or indirectly our Services ('Unauthorized person') except in connection with your official duties as an associate of the Group. Similarly, relatives of Persons deprived of the right to use the Services (Unauthorized Persons) are also not entitled to register in Our System or to use Our Services directly or indirectly. In this context, the term 'relatives' includes (but is not limited to) a spouse, partner, parents, children, siblings. In addition, it is prohibited to use Our Services for sports betting for the purpose of betting directly or through an intermediary, on any football-related events anywhere in the world, including (but not limited to) transfers of players, appointment of managers, selection of teams and disciplinary issues.
USE OF THE SERVICES
6.1
In order to ensure fairness, we may take any measures we deem necessary to create a fair and balanced game environment.
These measures relate to the provision of additional information, maintaining 24/7 contactability, dealing with consumer complaints within a lawful timeframe, implementing licensed monitoring products.
6.2
Without prejudice to your current and incomplete transactions related to the Services, We may terminate, modify, cancel and / or add Services (notifying you by email) with immediate effect; to the extent permitted by law, we are not responsible for such activities.
In any event, We will provide You with an opportunity to discontinue use of Our Services if You disagree with the changes.
If you do not agree to the changes, we will terminate the contract with you and deposits made will be refunded and bets settled under the rules in force before the changes were made, with no additional charges.
6.3
We prohibit the use of unfair practices in the use of the Services. Thus we protect our users and guarantee the integrity of the Services. For further information, please read our Unfair Advantage Policy, which is part of this Agreement and our Unfair Game Protection Policy in section 29.4. If a customer is found to be involved in any form of collusion to the detriment of a third party or other activity that we classify as unfair play, his account may be permanently closed and the account balance may be confiscated or withheld in accordance with section 17 of these General Terms of Use. In order to ensure fairness, we may adopt any reasonable measures we deem necessary to create a fair and balanced gaming environment.
6.4
We prohibit the publication of Prohibited Third Party Content (as defined below) on Our Platforms. For additional information, please read Our Third Party Content Policy included in this Agreement. In order to ensure fairness, we may adopt any reasonable measures we deem necessary to create a fair and balanced gaming environment.
6.5
We may block your use of certain Services, Platforms or games on Our Platforms for a certain period of time. In order to ensure fairness, we may adopt any reasonable measures we deem necessary to create a fair and balanced gaming environment.
6.6
None of the messages or information published in Our Services constitute legal or tax advice and we are not responsible for the interpretation of the provided content. In order to ensure fairness, we may adopt any reasonable measures we deem necessary to create a fair and balanced gaming environment.
6.7
When specifying the time in connection with your use of the Services, We use the GMT +1 time zone, unless otherwise specified. In order to ensure fairness, we may adopt any reasonable measures we deem necessary to create a fair and balanced gaming environment.
6.8
Our Services are for personal use only. The use of Our Services for commercial purposes is prohibited. In order to ensure fairness, we may adopt any reasonable measures we deem necessary to create a fair and balanced gaming environment.
6.9
We take the issue of Responsible Gaming seriously. If (i) you have had a mental disorder related to gambling or (ii) you have been treated for a mental disorder related to gambling, you are not entitled to use Our Service. If you feel that you have lost control or that you may lose control of your gambling or gambling expenses, you must notify us immediately. Please also familiarize yourself with the Responsible Gaming feature available in the Disabling Service section of your account and with our Self-Exclusion provisions below.
COPYRIGHT AND TRADEMARKS
The terms ElectraWorks Europe Limited, bwin.comand the other marks used by the Group are trademarks, service marks and / or trade names of the Group or of any of its subsidiaries or associates or its licensors. In addition, all other materials used by the Group, including (but not limited to) software, images, illustrations, graphics, photographs, animation, videos, music, audio recordings, texts (and all intellectual property rights in these and similar materials)) are owned by the Group or any of its subsidiaries or associates and / or its licensors and are protected by copyright and / or intellectual property law. You do not have any rights to the copyrighted materials or trademarks or service marks and may not use them without the written permission of the Group.
ELECTRONIC SERVICE PROVIDER
In order to use the Services, you will need to send us a payment and possibly accept payment from Us. We may use electronic payment systems and / or third-party financial institutions to process such financial transactions ('Electronic service providers'). If necessary, you irrevocably authorize us to instruct such Electronic Service Providers regarding the processing of account deposits and withdrawals from your account and you irrevocably grant us the right to give such instructions on your behalf according to your requests submitted through the relevant function of Our Platforms. You agree to be bound by the General Terms of Use of the respective Electronic Service Provider. In the event of any inconsistency or discrepancy between this Agreement and the General Terms of Use of the Electronic Service Provider, this Agreement shall prevail.
BONUSES
From time to time we may offer you free or bonus amounts that we will transfer to your Account ('Bonus(es)'). Such bonuses may only be used in connection with certain services specified in the terms of the bonus offer. The acceptance of the Bonus is carried out according to additional Terms, which can be sent to you for the respective bonus offer. In the absence of such Terms, the bonus will be accepted in accordance with the Standard Terms and Conditions for participation in promotions and the restrictions for using the bonus contained in the respective offer. Suggestions can only be used ONCE, unless otherwise stated. You may not withdraw bonus amounts and may not withdraw funds received through a Bonus from your account if you have not met the applicable conditions, including, but not limited to, all requirements or restrictions. With regard to Sports Betting Services, in addition to all additional applicable conditions, you may withdraw funds from your account received through a Bonus only after you have bet the quintuple bonus amount and the amount of the deposit (for which you have received a bonus) in a 5-fold amount at minimum decimal coefficient 1.7.
DRAWINGS
10.1
Your account balance is the amount of real money deposited into your account (by you or by Us) plus the winnings (including bonuses for which the applicable betting conditions have not been met) and / or minus the losses resulting from the use of Our services, minus rakes, entrance fees or other fees (if any), minus amounts previously withdrawn by you or amounts confiscated or cancelled by Us due to suspicion or proof of fraud or due to deposits or other transactions rejected or cancelled by your bank or relevant third party bank (whether due to insufficient account coverage, reversed funds, etc.), all fees for an inactive account (see Section 11 below), as well as any amounts that may be deducted or confiscated under the terms of this Agreement ('Balance of Accounts').
Withdrawals that would result in a negative balance on your account are not permitted.
10.2
You can see the standard deposit limits in your account. We reserve the right to control and change the deposit limits at any time.
In determining your personal limit, withdrawals from the account may be taken into account so that the eventual deposit amount will increase within 30 days to the amount of withdrawals made.
You have the option to reduce the standard deposit limit yourself, in which case the deposit limit is determined by you and may be changed again.
In addition, you may arrange with us to increase the standard limit, in which case we reserve the right to reduce the increased deposit limit to the standard limit at our discretion.
Acceptance of withdrawal requests is subject to there being sufficient cleared funds in your account (whether funds you have deposited, winnings or bonuses that you have been notified are available for withdrawal) available to meet your request. In this case, all restrictions according to the deposit method, restrictions on the utilization of the bonus and / or security checks (see Section 16 below) and all other provisions within the scope of this Agreement apply. The amounts you withdraw are subject to transaction limits and withdrawal methods, of which you will be notified before withdrawal. If you have received promotional or bonus money in your account, you must first comply with any terms and conditions for using the bonus contained in the promotion and/or terms and conditions pages. If you have not complied with the relevant requirements, you will not be allowed to withdraw money from your account until you have met the required bonus restrictions.
10.3
You agree that the maximum amount that you can withdraw per month is seventeen thousand euros (17 000€) (or the equivalent amount in BGN). All amounts in excess of seventeen thousand (17 000€) will be paid each subsequent calendar month until the full amount requested has been paid. This condition also applies to winnings from progressive jackpots.
10.4
We may provide a statement of or deduct an amount from your profits in order to comply with the applicable law. You are responsible for paying all taxes due in connection with the profits received. Your account balance cannot be transferred, exchanged or used for another prize. As We operate a ‘Closed Loop System’ for withdrawals to protect both Us and our customers from card theft and fraud, occasionally your withdrawal may be split across multiple payment methods when system security rules require funds to be returned to the payment method(s) used to deposit. We reserve the right to process withdrawals back to the payment method(s) used to make your deposit, up to the total amount deposited, before other withdrawal options are enabled.
10.5
Payments are made as soon as possible (internal processing takes up to two working days), although delays due to our security checks are not excluded (see Section 16 below) or in the event that we withhold any payment under the terms in this Agreement.
10.6
We shall only accept deposits pursuant to Article 6, Paragraph 3 of the Bulgarian Gambling Act only by payment service providers legally operating in the Republic of Bulgaria and/or the European Union.
FEES FOR INACTIVE ACCOUNT AND CLOSURE OF ACCOUNT
11.1
If you do not log into your account for 365 consecutive days using your username and password and (i) do not place a cash bet through the Services or (ii) do not participate in a tournament with an entry fee paid through the Gaming Services or (iii) you do not rake by hand through the Gaming Services, or (iv) you do not make the required deposit after these 365 days ('Grace Period') your account (and any linked account with an e-Service Provider) will is considered 'Inactive'.
11.2
Once your account is deemed inactive, we may charge an administrative fee ('Inactive Account Fee'). The amount of the inactive account fee may be deducted from your account balance on the day after the end of the Grace Period and thereafter every thirty (30) days in accordance with the Inactive Account Fee Schedule. We will also remove all unused tournament money for freeroll tickets from your account, including, but not limited to, cases where the tournament to which the freeroll applies is no longer valid. If your account is inactive for eighteen calendar months, in order to protect your money, we may deduct all other funds in your account and close your account. You can contact us and request the amount withheld at any time.
We will stop deducting an Inactive Account Fee from your Account Balance if your account is reactivated by participating in a tournament or making a cash bet, playing rake or making a deposit. These actions may also disable the Service Shutdown (as described below).
THIRD PARTY CONTENTS
12.1
Offensive and insulting statements are not allowed in our forums, on the Platforms or in communication with the staff of the Group. In addition, you may not post false and / or malicious and / or defamatory comments about the Group's activities in any media or forums.
12.2
Subject to the terms of our Third Party Content Use Policy, we may reject or delete texts, files, images, photos, videos, audio recordings or other material ('Third Party Content') that you post on the Platforms and that we believe violate the terms of this Agreement.
12.3
Any violation of this policy may result in the removal of third party content, a ban on the use of the Services and / or other similar measures that we may reasonably require to ensure compliance with this Policy.
DISCLOSURE OF USER NAME AND PASSWORD
The username and password chosen by you during registration must not be disclosed to third parties. You are solely responsible for protecting your username and password.
You agree to keep your username and password secret and not to allow their use by third parties. Any user who enters the system by entering the correct username and password is considered by Us to be the legal holder of the account and all transactions made by specifying the correct username and password are considered valid. We are in no way responsible for any losses incurred by you as a result of unauthorized use of or misuse of your access data. We are not required to store usernames or passwords. In case of lost username, password or other data for access to the account, please contact Us for their recovery. If you have registered incorrectly, if you have forgotten or lost your username, password or other data to access the account through your own fault and not as a result of Our error, We are not responsible for it to the extent permitted by law.
FRAUDULENT ACTIVITIES, PROHIBITED TRANSACTIONS AND FAILED DEPOSITS
We do not show any tolerance for improper play and fraud. If we believe that you are cheating or attempting to defraud Us and / or the Group or any other user of Our Services in any way, including, but not limited to, by manipulating games or paying fraud, manipulating multicurrency funds, betting on any possible outcome of a match or event or if we suspect fraud in making a payment, including the use of stolen credit cards or other fraudulent activity (including, but not limited to, cancellation of payment or other refunds) or a prohibited transaction (including but not limited to money laundering) or if your deposits have been diverted from your bank for any reason, We may block your account whilst we investigate the matter and / or close your account and use all existing legal methods to compensate for any losses incurred, including, but not limited to, (i) deduction of the amount due from you from your account; and (ii) the use of external debt collection firms to recover the debt. This may adversely affect your credit rating and will require Us to pass on your personal data (including your identity) to the relevant agencies, as well as to report all criminal and suspicious activities to the relevant authorities.
In the event that our investigation reveals you have been cheating or attempting to defraud us or have defrauded us, We will cancel or withhold, in whole or in part, the profits of a person or group of persons and to cancel or retain player points collected by a person or group of persons if we find evidence that the person or group of persons acted in conjunction with intent to defraud or in any way harm Us and / or the Group and / or the Services and / or the Platforms.
In the interests of personal data protection, security and fraud prevention, We do not authorize the use of communication channels provided as part of our Services and / or Platforms (including but not limited to, dealer table chat rooms) to offer and advertise offers, products and services (regardless of whether they are yours or a third party's). You are expressly prohibited from posting information or contacting our customers to offer or advertise offers, products or services.
With respect to Sports Betting Services, in the event that we suspect a match-fixing, price falsification or other manipulation, We may (i), suspend betting on a particular event or series of events in any of our markets; and (ii) delay and / or refuse to pay winnings for the event or series of events in question in any of our markets until the impartiality of the event or series of events in question has been proven by the relevant sports federation.
In the event that the Board of Directors of the respective sports federation confirms that there has been active manipulation of the outcome of the event or series of events, We will cancel all bets placed on these events or by an individual, identified as having inside information for placing bets, or by any other person who acts on his behalf or is in any way connected with such a person.
ERRORS
You are obliged to notify us immediately if you find errors in your account or in the calculation of your bets. In the event that such an error or malfunction in the system or an error in the game (deviation from the normal functioning of the logic of the game for any reason) leads to an error in the calculation of odds, winnings, fees, commissions, rake, bonuses or payouts ('Error'), We will try to return the result for all parties directly affected by such an Error in the state before the error has occurred. We may cancel bets affected by such Error and to withdraw from your account the amount associated with the respective bets. If you do not have sufficient funds in your account, we will require you to pay us the amount due relating to these bets. In all cases where We find that the error has been used to gain an unfair advantage, We consider such activity to be subject to Section 17 (Confiscation and Closure of Account) of these General Terms of Use.
SAFETY CHECK
In order to maintain a high level of security and integrity of the system, We conduct security checks on customers to verify your identity, age, registration data provided by you and to confirm your use of the Services, including but not limited to, compliance with the terms of this Agreement and the Group's policy, as well as your financial transactions made through the Services for potential breach of this Agreement and applicable law ('Security Check'). You hereby authorize Us and Our agents to use the necessary information about you and disclose it to a third party if we deem it necessary to confirm the information you provide to us or must provide to us under this Agreement, including but not limited to, requirement for credit report and / or other type of verification of the information with a database of third parties. Moreover, to facilitate these safety checks, you agree to provide any information and documentation that We may require to ensure we keep our information up to date.
CONFISCATION AND CLOSURE OF ACCOUNT
17.1
IN THE EVENT THAT:
17.1.1
You have committed a material breach of any of the terms of this Agreement, We will deactivate Your Account if You have materially breached any of the terms of this Agreement;
17.1.2
You have used or attempted to use the Services for the purpose of fraud, unfair play (including in respect of reversed payments) or illegal or unfair activity (including but not limited to, manipulation of multicurrency funds);
17.1.3
You have played on another site for online games and betting or services and that you are suspected of fraud, unfair play (including in respect of reversed payments) or illegal or unfair activity;
17.1.4
You have refused the payment or deposit of funds you have deposited into your account;
or
17.1.5
You have become insolvent or another similar case has been filed against you anywhere in the world, in which the Group operates.
TERMINATION AND EXCLUSION OF THE SERVICE
18.1
You have the right to block some or all of the products We offer (Poker, Casino, Sports Betting) available in your account (‘Service Exclusion’). If you activate "Service Exclusion", an inactivity fee will be deducted from your account according to section 11.2 above. You will find additional information in the section "Shutting down the service" in your account.
18.2
If you want to terminate your account, you need to enable the exclusion of all gaming services for an indefinite period of time.
18.3
Without limitation with respect to Section 17, we have the right to terminate this Agreement by giving seven (7) days' notice (or attempting to do so) to your email address you provided during registration. In the event of termination of the Agreement by Us, we will notify you by email and, unless termination is not in accordance with section 17, we will refund your funds as soon as possible. If the agreement is terminated under the terms of Section 17, the payouts, bonuses and winnings in your account will not be refunded and will be considered forfeited.
18.4
Termination of this agreement shall not affect outstanding bets PROVIDED THAT the outstanding bets are valid and do not in any way infringe the terms of this Agreement.
COMPENSATION
YOU AGREE TO USE THE SERVICES ONLY IN ACCORDANCE WITH THE TERMS CONTAINED IN THIS AGREEMENT. YOU WILL REFUND US IN FULL ALL LOSSES OR EXPENSES (INCLUDING ALL REASONABLE LEGAL FEES) THAT WE (OR A MEMBER OF OUR GROUP) HAVE INCURRED AND THAT HAVE ORIGINATED AS A RESULT OF YOUR BREACH OF THESE AGREEMENTS.
SELF-EXCLUSION
20.1
You have the right to request a temporary blocking of your account, self-exclusion or self-exclusion for an indefinite period, using the Responsible Gaming feature available in your account, section "Exclusion of the service". If you decide to use the tools for temporary blocking or self-exclusion, no inactivity fee will be deducted from your account, and your account balance (excluding bonuses) will be returned to you in accordance with the terms of this Agreement.
20.2
If you have chosen to use the temporary blocking or self-exclusion tool in respect of any of the Platforms provided by a Group company at any time, you acknowledge and agree that you are not permitted to open or use an Account registered with another Group company ( 'Additional Group Account') during the period you have selected.
20.3
In the event of a breach by you of the terms of Section 20.2, We and / or any of the Group companies have the right (but not the obligation) to block any funds you deposit (or have previously deposited) in a supplementary account of The Group.
20.4
For the avoidance of doubt, it should be noted that in the event of a breach by you of Section 20.2, neither We nor any of the Group companies shall be liable for the reimbursement of funds you have used for betting in the Additional Account of The Group during the period of your choice.
LIMITATIONS AND EXCLUSIONS
21.1
YOUR ACCESS TO THE PLATFORMS, DOWNLOADING OF SOFTWARE NECESSARY FOR THE USE OF THE SERVICES ON THE PLATFORMS AND THE USE OF THE SERVICES OR ANY INFORMATION THAT WE MAY PROVIDE IN CONNECTION WITH YOUR USE OF THE SERVICES IS AT YOUR CHOICE, AT YOUR DISCRETION AND YOUR RISK.
21.2
TO THE EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR (i) MALFUNCTION OF COMPUTER PROGRAMS RELATED TO THE SERVICES PROVIDED ON THE PLATFORMS; (ii) ERRORS DESCRIBED IN SECTION 15; (iii) BUGS OR VIRUSES LEADING TO LOSS OF DATA OR (iv) OTHER DAMAGES TO YOUR COMPUTER, MOBILE PHONE, MOBILE DEVICE OR SOFTWARE. IN ADDITION, WE ARE NOT RESPONSIBLE FOR ANY ATTEMPT BY YOU TO USE THE SERVICES THROUGH METHODS, MEANS OR WAYS WHICH ARE NOT ENVISAGED BY US. WE ARE NOT OBLIGATED TO PROVIDE ADDITIONAL OR SUPPORT NETWORKS AND / OR SYSTEMS.
21.3
WE WILL PROVIDE THE SERVICES WITH THE NECESSARY PROFESSIONAL ATTITUDE AND RESPONSIBILITY AND IN ACCORDANCE WITH THE PROVISIONS OF THIS AGREEMENT. WE DO NOT GIVE ANY OTHER PROMISES OR WARRANTIES REGARDING OUR SERVICES.
21.4
OUR MAXIMUM LIABILITY TO YOU OR ANY THIRD PARTY ARISING OUT OF THIS APREEMENT OR YOUR USE OF THE SERVICES OR COMPUTER PROGRAMS RELATING TO THE SERVICES WE PROVIDE ON THE PLATFORMS, WHETHER FOR BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHER VIOLATION WILL BE LIMITED TO ANY PERIOD OF TWELVE (12) MONTHS FROM THE AMOUNT, IF ANY, YOU HAVE PAID FROM YOUR ACCOUNT FOR BETTING, RAKES AND/OR FEES, AS THE CASE MAY BE, WITHIN THE SAME PERIOD OF TWELVE (12) MONTHS AND IN CONNECTION WITH THE RELEVANT SERVICE IN CONNECTION WITH WHICH THE LIABILITY IN QUESTION HAS AROUSED.
21.5
THE GROUP (INCLUDING MEMBERS OF ITS BOARD OF DIRECTORS, DIRECTORS, AGENTS AND EMPLOYEES) SHALL NOT BE LIABLE TO YOU ON THE BASIS OF THIS CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE FOR ANY INDIRECT LOSSES, INCLUDING BUT NOT LIMITED TO, LOSS OF DATA, PROFITS, REVENUES, BUSINESS OPPORTUNITIES, CLIENTS, GOODWILL OR BUSINESS INTERRUPTION OR FOR ANY LOSSES THAT THE GROUP CANNOT CURRENTLY FORESEE, ARISING OUT OF THIS AGREEMENT OR YOUR USE OF THE SERVICES.
21.6
NO PROVISION IN THIS AGREEMENT SHALL NOT BE INTERPRETED AS EXCLUDING LIABILITY WE MAY HAVE AS A RESULT OF FRAUD, DEATH OR BODILY INJURY AS A RESULT OF NEGLIGENCE ON OUR SIDE.
21.7
IF ANY PART OF THIS AGREEMENT IS FOUND UNLAWFUL, INVALID OR UNFEASIBLE FOR ANY REASON, THIS PROVISION SHALL BE REGARDED AS SEPARABLE FROM THE OTHER CONTENTS OF THE AGREEMENT AND SHALL NOT AFFECT THE VALIDITY AND ENFORCEABILITY OF ANY REMAINING PROVISIONS.
NOTES/COMPLAINTS
22.1
If you have a complaint about the services we offer, you must send it to us as soon as possible after the initial incident to which the complaint relates, by contacting the customer service team first. Complaints cannot be raised on social media. You are responsible for providing complete summarized information about your complaint with all relevant details, including (but not limited to) details of the specific transaction, exact date, time and time zone, screenshot or video, copy of promotional materials received, etc.
22.2
If you are not satisfied with the decision of the customer service team regarding your complaint within the scope of the procedure envisaged in paragraph 21.1, you can send your complaint in writing to: complaints@bwin.com. Our notifications addressed to you will be sent to the email address you provided when registering your account (unless otherwise stated). You are responsible for notifying us of any changes to your email address through the 'Change Email Address' feature in our software and for regularly checking your email for emails from us.
22.2.1
(i) Within 24 hours of receiving your complaint (filed under the above procedure), we will send you an acknowledgment of receipt. The final opinion will be e-mailed to you within 8 weeks of receiving the complaint, unless you are able to handle the complaint process in a timely manner. In case you are required to provide additional information, this period will be suspended until you provide it. The procedure will then continue from the moment it was stopped.
(ii) The complaint handling procedure shall be terminated if your complaint remains unresolved for 8 weeks after receipt (taking into account any suspensions in the provision of information); if we are unable to make a decision or if we reach a final opinion in less than 8 weeks. We will then send you an email with a final answer to the question.
22.3
If you are not satisfied with our final response under the above complaints handling procedure, you may lodge a complaint with the National Revenue Agency, which is the regulatory body for gambling.

We have the right to disclose your personal data to Our agents, who may use the information provided only for the same purposes determined by Us in accordance with the terms of this Agreement. We will use your personal data in accordance with the Privacy Policy.
In this regard, we ask you to familiarize yourself with the categories of personal data we collect and process, the purposes, the persons to whom we may provide data and the time limits for their storage. Withdrawal of your consent to process certain data may be made at any time, and this may restrict your use of our Services.
In all cases where you wish to restrict the provision of data such as "facial recognition", please contact us.
In the event that we enter into partnerships with third parties who perform certain functions for Us or We work under the brand of third parties, We may share and / or transfer your personal data and other information related to your use of the Services to third parties. You must accept that any use of Our website, emails, SMS messages and telephone conversations between you and Us will be recorded. These records are our property and may be used as evidence in case of disagreement or to improve customer service.
APPLICABLE LEGISLATION
This Agreement shall be governed by and construed in accordance with the laws of Bulgaria. You irrevocably agree that any dispute or matter arising out of or in connection with this Agreement or its enforceability shall be subject to the exclusive jurisdiction of the relevant Bulgarian Court. If any part of this Agreement is found to be invalid, illegal or unenforceable in any way, this will not affect the validity of the remaining parts of the Agreement that remain valid and applicable under the terms of this Agreement.
TRANSFER OF RIGHT
We may in certain circumstances permitted by law, assign or cede in whole or in part the rights and obligations arising from this Agreement to persons (without your consent) by notifying you of such transfer by e-mail, provided that any such transfer will be subject to the same terms or conditions that are no less advantageous to you. You may not assign, cede or otherwise transfer your rights and obligations under this Agreement.
RIGHTS OF THIRD PARTIES
26.1
You may not transfer any rights or obligations under this Agreement to any other third party.
26.2
For the avoidance of doubt, it should be noted that each member of the Group is a intended third party beneficiary under this Agreement.
TOTAL AGREEMENT, AMENDMENTS AND SUPPLEMENTS
You fully understand and agree to be bound by this Agreement and its amendments, which we will make from time to time. Subject to approval by the Executive Director of the National Revenue Agency, We may amend this Agreement at any time by notifying you of the new terms by email. Any such amendment shall enter into force within fourteen (14) days of the date on which we send you notice of the amendment (‘Notice’). If any change is unacceptable to you, the only option is to stop playing and close your account according to section 18.2. If you continue using the Services after the expiration of the 30-day period, this will be considered as a binding acceptance of the changes by you. You are solely responsible for reviewing this Agreement and any Notices each time before proceeding with the game.
SPORTS BETTING SERVICES
28.1
The following terms apply only to your use of the Sports Betting Services. Please note that in the event of a conflict between this Section 28 and the other Sections in these General Terms and Conditions, Section 28, which relates to the use of Sports Betting Services, shall prevail.
28.2. Rules and procedures of the Sports Betting Services
You agree to use the Sports Betting Services in accordance with the generally accepted rules of the game set out in Our Sports Betting Services Rules and on any other page that relates specifically to and governs the specific event, match or tournament ('Rules'). We recommend that you read all these rules carefully.
28.3. Betting rules
We reserve the right to use symbols (eg. 1, X, 2) and abbreviations to indicate betting results. We will maintain a permanent Help section in connection with Sports Betting Services, where information on the types of bets and the applicable conditions will be provided. We advise you to read in advance the exact details of each bet before placing it. Any additional information placed above or below the name of the event and the odds is part of the betting rules for the specific event and in case of non-compliance it will take precedence over these conditions. We advise you to read all the information carefully.
28.3.1 Bet Limits
We reserve the right to limit the maximum amount placed on a single or combined bet. For more information, please see Sports Betting - General Rules.
28.3.2 Profit limits
The maximum total amount you can earn through the Sports Betting Services over a period of 24 hours is, depending on the currency you choose, EUR 25,000 or BGN 490,000. This maximum does not depend on the number of bets placed or ordered or on the amount of bets placed or requested and the acceptance of your bet by Us does not constitute a liability to pay if your net profit exceeds Our profit limit (see above) and it is your responsibility to be aware that you will not be paid if your net profit exceeds this limit.
The maximum amount you are allowed to win through the Single Bet Sports Betting Services is, depending on the currency you choose, EUR 10,000 or BGN 20,000.

28.3.3 Calculation of profits
In the case of bets with fixed decimal coefficients, the profit is calculated by multiplying the amount of the bet by the respective fixed decimal coefficient. In live betting, you accept any changes in the decimal odds during the betting process. Changes in the decimal coefficients mean changes that may occur in the period between the addition of the forecast in the betting coupon and the acceptance of the bet by Our side. The final decimal odds are displayed in your bet confirmation message. In the event that you place more than one bet (including a combination of single and combined bets) and your total winnings exceed the winning limit specified in section 28.3.2 above, we have the right to reduce the payout amount in order to comply with the corresponding profit limits.

28.3.4 Accuracy of bets and results
In order to ensure maximum accuracy of all bets and results, we calculate the funds in your account using four digits after decimal point. For technical reasons, your account balance can only be displayed with up to two digits after the decimal point, which can occasionally lead to discrepancies when the four-digit value after the decimal point is rounded to two-digit values after the decimal point.
28.4 Acceptance and confirmation of the Terms
28.4.1
Bets must be made through the Sports Betting Services.
28.4.2
A bet is considered valid after confirmation of its acceptance by Our remote servers. A bet is confirmed when it appears in the user's account in the "My bets" section. When a bet is placed and accepted, the respective amount is deducted from your account. Once accepted, bets can no longer be cancelled or altered in any way.
28.4.3
When you place a bet, you confirm that you do not know in advance the result of the relevant event you are betting on ('Event'). If during the period of acceptance of bets, information appears, through which the result of an event can be determined, We reserve the right to change the deadline for acceptance of bets or to cancel the placed bets.
28.4.4
We reserve the right to cancel any bet, including, but not limited to, an inadvertently accepted bet if your account does not have sufficient funds to cover the amount of the bet placed before the event. In accordance with the above, if the balance of your account partially covers the amount of the bet, We reserve the right to accept your bet at a value equal to the balance on your account. We also reserve the right to take all necessary measures to protect you from further losses if you have lost EUR 5,000 (or the equivalent of this amount in another currency) or more over a period of four weeks.
28.4.5
All bets must be placed and accepted before the start of the relevant Event. Any bet placed or accepted after the start of the Event will be void, unless the betting offer explicitly states that the bet is available after the start of the Event (I.e. live betting, final winner).
28.4.6
In the case of live betting, if a delay in television broadcast or data transfer results in a bet being placed at the wrong price, after which the selected participant / team achieves a significant advantage, We reserve the right to cancel the bet, win or loss.
28.4.7
If an Event is cancelled or declared invalid, the corresponding selection is calculated with a neutral decimal coefficient unit (1.00). In the case of a single bet, the amount of the bet is refundable. In the case of combined bets in which the cancelled event appears together with other valid events with a winning prediction, the combined bet is considered won, but the total odds are adjusted accordingly.
28.4.8
Combined bets are not accepted if the result of one part of the bet affects the result of another.
28.4.9
We reserve the right to refuse all or part of a bet and all ambiguous bets will be void.
28.4.10
We reserve the right to terminate, modify, cancel and / or add Sports Betting Services at Our sole discretion with an immediate effect by notifying you by email. To the extent permitted by law, we are not responsible for such actions.
28.5 Changes in the currency of the account
For the avoidance of doubt, it should be noted that in the event that you change the currency of your account during the term of the bet, all winnings will be converted into the new currency of your account according to the exchange rates at the time of payment.
28.6 Early Payout
We can only offer 'Early Payout' for live betting. You have the opportunity to accept the evaluation of the bets placed by you before the outcome of the bet is determined. The amount of the 'Early Payout' is calculated based on the current situation in the match and may change depending on when you have chosen 'Early Payout'. If an 'Early Payout' is offered for a bet, the corresponding symbol will be displayed in the 'My bets' section of the betting slip.
The 'Early Payout' feature is only available for single bets. There is no 'Early Payout' option for combined and system bets. 'Early Payout' is not taken into account in terms of betting conditions if bonuses have been used to place the bet.
If a bet is frozen or closed, or if the value of the 'Early Payout' has changed during the match, the early payout may be rejected.
If an Early Payout has been accepted by Us when the outcome of the relevant bet has already been determined, We reserve the right to cancel the 'Early Payout'. In addition, we reserve the right to cancel and claim back the amount of the 'Early Payout' early payment if we believe you have abused the 'Early Payout' feature.
GAMING FACILITIES
29.1.
The following terms apply only to Your use of the Gaming Facilities. Please note that in the event of any conflict between this Section 29 and the remaining sections of these Terms and Conditions, the remaining Sections of these Terms and Conditions shall prevail.
29.2. Play Money and Real Money Games
By registering for the Gaming Facilities, You will be able to access (through theSoftware (as defined below)) both ‘play money’ games and tournaments ('Play Money Games' or 'Play for Free Games') and “real money” games and tournaments (‘Real Money Games’ or ‘Play for Real Money Games’) through the Gaming Facilities. No purchase is necessary or required in order to play the Play Money Games save in respect to any cost You may incur to access the Gaming Facilities, charged by Your Internet service provider or telecommunication service provider and You may play the Play Money Games without betting money. We reserve the right to suspend, modify, cancel, remove and / or add any Gaming Facilities in its sole discretion with immediate effect by notifying You by email. 29.4 Anti-Cheating Policy
29.4.1 Anti- Cheating Policy
We are committed to preventing the use of unfair practices in the Gaming Facilities, including but not limited to player collusion, non-human players (bots), chip-dumping, scripting and other forms of inappropriate behaviour that provide players with an unfair advantage (Unfair Advantage Policy) over other players on the site. We are also committed to detecting and preventing the use of software programs which are designed to enable artificial intelligence to play on Our Platforms including, but not limited to, opponent-profiling, cheating software or anything else that we deem would enable You to have an unfair advantage over other players not using such programs or systems ('AI Software'). You acknowledge that We will take measures to detect and prevent the use of such programs and AI Software using methods (including but not limited to reading the list of currently running programs on a player's computer) and You agree not to use any AI Software and/or any such programs. In the event that We suspect that a player has been involved in any practices outlined in this Clause 29.4 or any other practices which We deem to be unfair or fraudulent, We reserve a right, in Our sole discretion, to block their account and permanently withhold available funds from within such accounts. No player shall have the right to require Us to take any other steps against players suspected of collusion, cheating, scripting or any other form of unfair or fraudulent behaviour. If a player has been cheated on by another player when using the Facilities, We shall only refund the amounts lost by the player as a result of being cheated in the event that We can locate the cheating account and access the funds in question. In the event that more than one player is affected by the cheating account and We can allocate that cheating account, then the remaining funds in the cheating account will be distributed on a pro-rata basis in accordance with the loss of each affected player.
29.4.2 Collusion and Cheating
Collusion occurs when two or more players attempt to gain an unfair advantage by sharing knowledge of their cards or other information. Any player who in our reasonable opinion colludes or attempts to collude with any other player while using the Facilities may be permanently banned from using the Facilities or the software, their account may be terminated immediately and We shall be entitled to retain all monies in such player's account. 29.4.3 Automatic Players (Bots)
The use of artificial intelligence which plays without human intervention or reduces the requirement of a human playing including, without limitation, “robots”, is strictly forbidden in connection with Our Facilities. All actions taken in relation to the Facilities by a player must be executed personally by players through the user interface accessible by use of the Facilities. If You suspect that any player is using any kind of artificial intelligence, please Contact Us.
29.4.4 Chip-Dumping
Chip dumping occurs when any player intentionally loses a hand in order to deliberately transfer his chips to another player. Any player who we reasonably suspect of participating or attempting to participate in chip-dumping with any other player, while using the Facilities may be permanently banned from using the Facilities and their account may be terminated immediately. 29.5 Software
You may install and use the software We make available from the Platforms used to provide the Gaming services (the 'Software') on a hard disk or other storage device and make back-up copies of the Software, provided that such use and back-up copying is only for Your own personal use in using the Gaming Facilities in accordance with these Agreements, and further, that such installation and use is made through a computer or other device of which You are the primary user. The Software's structure, organisation and code are the valuable trade secrets of the Group and/or its associated companies and/or licensors. You obtain no rights to the Software, except to use it in accordance with these Agreements. Save as expressly permitted by law, You are strictly prohibited from, and agree not to modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Software or any part of it or to create, publish or distribute derivative works from the Software. You agree that the Software will not be shipped, transferred or exported into any country or used in any manner prohibited by any applicable laws, restrictions or regulations.
29.6 Shared Games, Table and Database Platform
We reserve the right, but are not obliged, to run and utilise a shared table, server and database platform or system ('Shared Game/Table Platform') which enables Gaming Facilities users to play with players coming into the games, tables and tournaments from other websites and brands operating on the same Shared Game/Table Platform. If a Shared Game/Table Platform is used, You agree that You may be pooled into these common game/tables, at Our sole discretion, and that to the extent that You breach the Terms and Conditions of one site or brand that operates on the Shared Game/Table Platform, We may have You blocked, in part or in full, from the entire system so that You may not play through any site or brand using, or on the Shared Game/Table Platform. Without limitation to the restriction on having multiple Accounts with Us (please see Section 4), We may require that You only have one Account on the Shared Game/Table Platform if the same is used.
29.7 Play Money and Real Money Account Funding
'Play money' funds have no value and are kept separate from 'real money' funds. They are not transferable to a 'real money' account nor are they redeemable for any currency. We do not promise to accurately record the number of play money chips held by You, and Your play money chips may be lost at any time. Further, We reserve the right to set a maximum chip limit for play money Accounts.
29.8 Settlement of In-Game Disputes
You fully accept and agree that random number generator ('RNG') software will determine the shuffling and dealing of cards and other randomly generated events required in the Gaming Facilities. If there is a discrepancy between the result showing on the Software (as installed and operated on Your hardware) and Our server, the final result shall be determined by the results shown on Our server. Moreover, You understand and agree that (without prejudice to Your other rights and remedies) Our records shall be the final authority in determining the terms of Your use of the Gaming Facilities, the activity resulting therefrom and the circumstances in which such activity occurred.
29.9 Real Money Game and Tournament Currency
Where a Real Money Game or tournament is only available in a currency which is different from Your Account Currency, You may in some cases be given the option to buy in to the same in the currency of the relevant game/tournament. Such buy-in (together with any winnings) will be subject to the terms and Exchange Rates offered by Us at the relevant time. In all other cases You will only be permitted to place bets and wagers in Your Account currency.
